What Is Workers’ Compensation in Florida?

What Is Workers’ Compensation in Florida?

Workers’ compensation is an insurance system in which most Florida employers must participate. Pursuant to Florida law, employers with four or more employees must carry a workers’ compensation insurance policy to help employees deal with medical bills and lost wages when they suffer a work-related injury or are diagnosed with an occupational disease

Virtually all employers in the construction industry must carry a policy. Benefits can be awarded to qualifying workers even when they share some or all of the responsibility for a work-related injury. In exchange for receiving these no-fault benefits, the worker waives the right to file a lawsuit against their employer for damages, even if the employer was negligent.

The system gives workers an opportunity to recover compensation without having to navigate a costly, potentially time-consuming lawsuit. At the same time, employers don’t have to worry about endless litigation when a worker is hurt on the job.

Do I Qualify For Workers’ Compensation Benefits?

Do I Qualify For Workers’ Compensation Benefits?

Not everyone qualifies for workers’ compensation benefits. Certain prerequisites must be satisfied before you can successfully receive compensation for medical expenses and loss of income.

You can qualify to receive monetary benefits from your employer’s workers’ compensation policy if:

  • You’re classified as an employee (this includes part-time and seasonal work)
  • You suffered an injury while carrying out responsibilities within the scope of your employment, and
  • You work for an employer who’s required to maintain coverage.

Your accident, injury, or illness doesn’t necessarily have to be sustained on your employer’s premises. As long as you were actively doing your job when you got hurt, you can qualify for benefits. For example, a work-related car or truck accident could lead to a successful claim for benefits. On the other hand, getting into a collision on your lunch break or while commuting to or from work likely wouldn’t.

What Benefits Does Workers’ Compensation Pay in Florida?

What Benefits Does Workers’ Compensation Pay in Florida?

Florida’s workers’ compensation system offers limited economic support for qualifying workers. These benefits fall into two main categories: medical expenses and wage replacement.

Medical Expenses

Insurance should cover the reasonable and necessary costs of treating your work-related injury or illness, such as:

  • Emergency room visits
  • Diagnostic testing
  • Blood draws and lab work
  • Surgery
  • Hospitalization
  • Medication
  • Medical devices
  • Medical equipment
  • Prosthetics
  • Dentistry
  • Chiropractic care
  • Specialist consultations
  • Rehabilitation

You will have to seek care from a workers’ compensation-approved healthcare provider if you want your medical bills covered by workers’ compensation. This can limit your ability to see your own doctor or voice how your treatment and rehabilitation unfold.

Wage Replacement Benefits

If your work injury interferes with your ability to do your job, wage replacement benefits can be awarded to alleviate some of the financial stress you experience as a result.

There are four main wage replacement benefits:

  • Temporary total disability: TTD benefits can be paid if you’re unable to work in any capacity for more than a week.
  • Temporary partial disability: TPD benefits bridge the gap between your current income and your pre-injury income.
  • Impairment income: Impairment income benefits (IIB) can be awarded when you reach maximum medical improvement (MMI) but still suffer from some level of impairment or disability.
  • Permanent total disability: Permanent total disability (PTD) benefits may be available if your work injury prevents you from returning to gainful employment in any capacity.

These benefits are typically limited by Florida law.

Benefits will not cover non-economic losses like pain and suffering, disfigurement, or other hard-to-value trauma. These can only be awarded if you file a related civil tort claim against a third party.

Can I Receive Workers’ Compensation Benefits if I’m Partly To Blame for My Work-Related Injury?

Can I Receive Workers’ Compensation Benefits if I’m Partly To Blame for My Work-Related Injury?

Since workers’ compensation is a private system, benefits can be awarded even if you share responsibility for your workplace accident and injury.

However, shared fault will be a factor if you decide to pursue additional compensation through a related personal injury lawsuit. In these situations, damages paid to you in a settlement or jury award can be reduced proportionately to your share of fault up to 51 percent.

Sharing more than 50% of the blame for a workplace injury can be a total bar to recovery in a lawsuit.

How Long Do I Have To Pursue Workers’ Compensation Benefits in Florida?

How Long Do I Have To Pursue Workers’ Compensation Benefits in Florida?

Before you can file a claim, you need to make sure you tell your employer that you got hurt on the job. You must provide notice within a certain amount of time of your injury (or diagnosis) to reserve the right to collect workers’ compensation benefits.

As long as you’ve satisfied the notice requirement, there are additional deadlines you must meet. Otherwise, you can forfeit the right to recover critical economic benefits from your employer’s insurance company.

You should speak with an experienced workers’ comp attorney to understand these deadlines.
